Hi\u00e7bir gerek\u00e7e belirtmeden istifa eden i\u015f\u00e7i k\u0131dem tazminat\u0131 \u00f6demesi alamaz. \u0130\u015f Kanunu 17. Maddesine g\u00f6re y\u00f6neticilere i\u015ften ayr\u0131laca\u011f\u0131na dair yaz\u0131l\u0131 bildirimde bulunmayan \u00e7al\u0131\u015fan i\u015f\u00e7i ihbar tazminat\u0131 \u00f6demek durumunda dahi kalabilir. Ancak baz\u0131 durumlarda, \u0130\u015f Kanunu\u2019nun 14. Maddesi gere\u011fi hakl\u0131 gerek\u00e7elerle, i\u015f s\u00f6zle\u015fmesinin i\u015f\u00e7i taraf\u0131ndan feshi durumunda i\u015f\u00e7i k\u0131dem tazminat\u0131 alabilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u0130stifa Eden \u0130\u015f\u00e7inin K\u0131dem Tazminat\u0131 Alabilece\u011fi Durumlar<\/h2>\n\n\n\n<p>\u0130stifa eden i\u015f\u00e7inin k\u0131dem tazminat\u0131na hak kazanabilmesi i\u00e7in k\u0131deminin en az 1 y\u0131l olmas\u0131 gerekir. Bu ko\u015fulu sa\u011flayan i\u015f\u00e7i istifa etmesi durumunda \u015fu hallerde k\u0131dem tazminat\u0131 alabilir:<\/p>\n\n\n\n<p>Erkek i\u015f\u00e7i askerlik g\u00f6revi sebebiyle i\u015ften \u00e7\u0131kmak durumundaysa,<\/p>\n\n\n\n<p>Emeklilik hakk\u0131 elde eden ki\u015fi i\u015ften ayr\u0131lmaya karar verirse,<\/p>\n\n\n\n<p>Kad\u0131n i\u015f\u00e7i evlilik tarihinden bir y\u0131l s\u00fcre i\u00e7in evlilik halini gerek\u00e7e g\u00f6stererek i\u015ften \u00e7\u0131kmas\u0131 halinde k\u0131dem tazminat\u0131 hakk\u0131 kazanacakt\u0131r.<\/p>\n\n\n\n<p>\u0130\u015f Kanunu\u2019nun 24. Maddesinde say\u0131lan hakl\u0131 sebepleri gerek\u00e7e g\u00f6steren, i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenlerle fesheden \u00e7al\u0131\u015fan k\u0131dem tazminat\u0131 alabilir.<\/p>\n\n\n\n<p>\u0130\u015f s\u00f6zle\u015fmesinin hakl\u0131 nedenlerle feshedilece\u011fi durumlara \u015fu \u00f6rnekler verilebilir:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>\u0130\u015f\u00e7i \u00fccretlerinin ve haklar\u0131n\u0131n \u00f6denmemesi, eksik \u00f6denmesi<\/li><li>SGK \u00f6demelerinin ger\u00e7ek miktar \u00fczerinden yap\u0131lmamas\u0131<\/li><li>SGK\u2019dan i\u015f\u00e7inin haberi olmadan giri\u015f-\u00e7\u0131k\u0131\u015f yap\u0131lmas\u0131<\/li><li>\u0130\u015f\u00e7iye fazla mesai \u00fccretinin \u00f6denmemesi<\/li><li>\u0130\u015f\u00e7inin resm\u00ee tatillerde \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131<\/li><li>\u0130\u015f\u00e7inin i\u015fveren taraf\u0131ndan istifaya zorlanmas\u0131.<\/li><\/ul>\n\n\n\n<p>\u0130\u015f\u00e7i taraf\u0131ndan yap\u0131lan feshin hakl\u0131 olup olmad\u0131\u011f\u0131na somut durumu g\u00f6z \u00f6n\u00fcne alan hakim kesin karar verecektir.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u0130\u015f Kanunu\u2019na g\u00f6re istifa eden, yani i\u015f s\u00f6zle\u015fmesini s\u00fcreli fesih yoluyla fesheden, \u00e7al\u0131\u015fan k\u0131dem tazminat\u0131na hak kazanamaz.
